1. Description of Service

Dent provides a platform to facilitate collision repair services in Florida. Our Service includes providing preliminary, AI-powered cost estimates ("Estimates"), coordinating vehicle pickup and delivery, and managing repairs performed by a network of third-party, licensed, and insured repair facilities ("Repair Shops").

2. Preliminary Estimates

You acknowledge and agree that all Estimates provided through our Service are preliminary, non-binding, and for informational purposes only. These Estimates are generated based on user-provided information and photos. The final cost of repair is subject to a physical inspection of the vehicle by a qualified technician at a Repair Shop and may differ from the initial Estimate. We are not liable for any discrepancies between the preliminary Estimate and the final repair cost.

3. Repair Process & Lifetime Warranty

All repair work is performed by independent, third-party Repair Shops. While we facilitate the service, we are not the direct provider of the repairs. Dent Automotive provides a lifetime warranty on the workmanship of all repairs arranged through our Service for as long as you own the vehicle. This warranty is your sole and exclusive remedy for any defects in the repair work. This warranty does not cover damage from subsequent accidents, normal wear and tear, or failure to maintain the vehicle.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, IN NO EVENT SHALL DENT AUTOMOTIVE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM:

• Any errors, mistakes, or inaccuracies of content or Estimates.
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our Service.
• The quality of work, actions, or omissions of any third-party Repair Shop. Your recourse for repair-related issues is strictly limited to the lifetime warranty provided by Dent.
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
• Any interruption or cessation of transmission to or from our Service.

Our total liability to you for any and all claims arising from the use of the Service is limited to the amount you paid to us for the specific service giving rise to the claim.

5. Indemnification

You agree to defend, indemnify, and hold harmless Dent Automotive and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or your violation of any term of these Terms of Service.

6. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida, without respect to its conflict of laws principles. You agree that any claim or dispute you may have against Dent must be resolved exclusively by a state or federal court located in Palm Beach County, Florida.

7. Changes to Terms

We reserve the right to amend these Terms at any time by posting the amended terms on our website. Your continued use of the Service after such posting constitutes your acceptance of the new Terms.
